High School are not deprived of the facilities necessary to provide them education

The Supreme Court has requested the Hyderabad High Court to decide within three months, a dispute involving the correspondent of Asafia Primary High School in Malakpet. The school is run by the Majlis-e-Umna of Mumtaz Yaruddowla Trust, which was set up by Mumtaz Yaruddowla, a prominent personality, to spread education in the Muslim community.

A single judge of the Hyderabad High Court in April 2017 granted stay on the proceedings issued by the district educational officer and the Hyderabad collector in replacing Mr Mahaboob Alam Khan as the the correspondent of Asafia School with Mr Shah Mohamed Sayeeduddin. In September, the single judge made the stay absolute by observing that the issue needed detailed hearing.Aggrieved by the interim order, Mr Sayeeduddin moved an appeal before the division bench which it observing: “We are not inclined to interfere with the order of the single judge, we consider it appropriate to direct the commissioner and director of school education and the Hyderabad district educational officer to take necessary action to ensure that the students studying in Asafia Primary and High School are not deprived of the facilities necessary to provide them education.”

Mr Sayeeduddin moved the apex court and a two-member bench comprising Justice Arun Mishra and Justice Uday Umesh Lalit expressed its disinclination to interfere with the judgment of the High Court, stating that the impugned order was interlocutory in nature.
