HC issued notices to the Centre and the Telangana governments

The Hyderabad High Court on Tuesday issued notices to the Centre and the Telangana governments asking them to respond to a PIL seeking to make certain amendments to the Land Transfer Regulation Act, 1970.

A division bench comprising Acting Chief Justice Ramesh Ranganathan and Justice J. Uma Devi was dealing with the PIL by Sureddy Ramana Reddy, a resident of Chunchupally village in Bhadradri Kothagudem.

The petitioner moved the PIL as a party in person seeking to declare that the Regulation 31(a) of the Telangana Scheduled Areas Land Transfer Regulation 1959 as amended by Regulation No I of 1970 to the extent it deprives the right of residence of non-tribals in the scheduled areas in Telangana as illegal and violative of Article 14 19 and 21 of the Constitution.

Stating that he was not against to the interests of the tribals in the Scheduled areas, he told the court that non-tribals have been residing in the areas for the past several decades and due to the prohibition against transfer of immovable property in scheduled areas by non-tribals in favour of non- tribals they are facing severe hardships.
