HC to hear petition on Madhusudhana chary and Srinivas

The Hyderabad High Court on Thursday agreed to hear a writ petition next week seeking declaration of continuance of Telangana Assembly Speaker S. Madhusudhana Chary and Minister Talasani Srinivas Yadav in their respective offices arbitrary and unconstitutional.

A Division Bench comprising Chief Justice Thottathil B. Radhakrishnan and Justice Ramesh Ranganathan agreed to hear the petition filed by advocate G. Malleswara Rao. The petitioner sought an order in the form of quo warranto against continuance of Mr. Chary and Mr. Yadav in their posts. He also pleaded for setting aside the Speaker’s order dated March 10, 2016, recognising merger of the Telangana Telugu Desam Party with the ruling Telangana Rashtra Samiti Party.

He submitted to the Bench to issue an interim order restraining Mr. Yadav from discharging functions as an MLA and Minister till the matter was finalised. The Bench asked the petitioner to justify the inclusion of Governor as first respondent. The two judges asked him to delete Governor as respondent in the petition and he agreed to it.

Mr. Rao argued that Mr. Yadav was ineligible to continue as an MLA as he got elected on TDP ticket and joined the TRS. He maintained that the MLA openly declared that he had quit the TDP and joined the TRS. The petitioner told the Bench that Mr. Yadav flaunted his resignation letter addressed to the Speaker openly earlier. He stated in the petition that Mr. Chary could not continue in the position of Speaker as he delayed decision on the disqualification of Mr. Yadav. Additional Advocate-General J. Ramachandra Rao submitted to the Bench that a similar petition related to Andhra Pradesh had been dismissed by another Bench of the HC recently.
